achizi\u0163ioneaz\u0103 \u015fi utilizeaz\u0103 sisteme de Inteligen\u0163\u0103 Artificial\u0103 (IA) cu grad ridicat de risc la locul de munc\u0103 vor face obiectul unor exigen\u0163e stricte \u00een ceea ce prive\u015fte utilizarea acestora, iar pentru nerespectarea obliga\u0163iilor legale angajatorii risc\u0103 amenzi de p\u00e2n\u0103 la 35 de milioane de euro sau de p\u00e2n\u0103 la 7% din cifra de afaceri mondial\u0103 total\u0103 anual\u0103 pentru exerci\u0163iul financiar precedent, conform unei analize de specialitate, publicate luni de EY.<\/p>\n<p>Regulamentul european adopt\u0103 o abordare bazat\u0103 pe riscuri \u015fi clasific\u0103 sistemele de IA \u00een patru categorii de risc: inacceptabil, ridicat, limitat \u015fi minim, au explicat consultan\u0163ii companiei.<\/p>\n<p>\u201cUtilizarea IA pentru a deduce emo\u0163iile unei persoane fizice \u00een sfera locului de munc\u0103 prezint\u0103 un grad de risc inacceptabil \u015fi este interzis\u0103, reprezent\u00e2nd o ingerin\u0163\u0103 la adresa valorilor UE \u015fi a drepturilor fundamentale. De asemenea, av\u00e2nd \u00een vedere impactul semnificativ pe care \u00eel pot avea asupra carierei, mijloacelor de subzisten\u0163\u0103 \u015fi drepturilor lucr\u0103torilor, urm\u0103toarele sisteme de IA din domeniul ocup\u0103rii for\u0163ei de munc\u0103 \u015fi gestion\u0103rii lucr\u0103torilor sunt considerate ca prezent\u00e2nd un grad ridicat de risc: cele destinate recrut\u0103rii sau select\u0103rii persoanelor fizice, \u00een special pentru a plasa anun\u0163uri de angajare direc\u0163ionate \u00een mod specific, pentru a analiza \u015fi a filtra candidaturile pentru locuri de munc\u0103 \u015fi pentru a evalua candida\u0163ii; cele destinate lu\u0103rii deciziilor care afecteaz\u0103 termenii derul\u0103rii rela\u0163iilor de munc\u0103, promovarea \u015fi \u00eencetarea rela\u0163iilor contractuale legate de munc\u0103, pentru a aloca sarcini pe baza comportamentului individual sau a tr\u0103s\u0103turilor ori caracteristicilor personale sau pentru a monitoriza \u015fi evalua performan\u0163a \u015fi comportamentul persoanelor aflate \u00een astfel de rela\u0163ii\u201d, se men\u0163ioneaz\u0103 \u00een analiz\u0103.<\/p>\n<p>\u00cen acela\u015fi timp, prin excep\u0163ie, aceste sisteme nu vor fi considerate ca av\u00e2nd un grad ridicat de risc, dac\u0103 nu prezint\u0103 un risc semnificativ de a aduce prejudicii s\u0103n\u0103t\u0103\u0163ii, siguran\u0163ei sau drepturilor fundamentale ale persoanelor fizice, inclusiv prin faptul c\u0103 nu influen\u0163eaz\u0103 \u00een mod semnificativ rezultatul procesului decizional. \u201cCu toate acestea, chiar \u015fi \u00een situa\u0163iile exceptate, aceste sisteme vor fi considerate \u00eentotdeauna ca prezent\u00e2nd un grad ridicat de risc, dac\u0103 creeaz\u0103 profiluri ale persoanelor fizice\u201d, noteaz\u0103 consultan\u0163ii.<\/p>\n<p>La capitolul obliga\u0163ii, companiile care utilizeaz\u0103 IA \u00een rela\u0163iile de munc\u0103 trebuie s\u0103 respecte instruc\u0163iunile de utilizare puse la dispozi\u0163ie de c\u0103tre furnizorii de sisteme IA, prin adoptarea de m\u0103suri tehnice \u015fi organizatorice corespunz\u0103toare \u00een acest sens.<\/p>\n<p>De asemenea, supravegherea acestor sisteme cu grad ridicat de risc va trebui s\u0103 fie \u00eencredin\u0163at\u0103 unor persoane care dispun de competen\u0163a, formarea, autoritatea \u015fi sprijinul necesar, fie prin angajarea de resurse umane adecvate, fie prin extinderea responsabilit\u0103\u0163ilor personalului relevant existent. \u201cAcestor persoane trebuie s\u0103 li se permit\u0103, printre altele, s\u0103 interpreteze corect rezultatele sistemului de IA cu grad ridicat de risc, \u0163in\u00e2nd seama de instrumentele \u015fi metodele de interpretare disponibile, precum \u015fi s\u0103 decid\u0103 s\u0103 nu utilizeze sistemul de IA cu grad ridicat de risc sau s\u0103 ignore, s\u0103 anuleze sau s\u0103 inverseze rezultatele acestuia\u201d, explic\u0103 sursa citat\u0103.<\/p>\n<p>\u00cen acela\u015fi context, companiile care implementeaz\u0103 sisteme de IA trebuie s\u0103 se asigure c\u0103 at\u00e2t personalul propriu, c\u00e2t \u015fi alte persoane care se ocup\u0103 cu operarea \u015fi utilizarea acestor tipuri de sisteme \u00een numele lor, dispun de competen\u0163ele \u015fi cuno\u015ftin\u0163ele necesare \u00een materie.<\/p>\n<p>\u201c\u00cenainte de a pune \u00een func\u0163iune sau de a utiliza un sistem de IA cu grad ridicat de risc la locul de munc\u0103, angajatorii trebuie s\u0103 informeze reprezentan\u0163ii lucr\u0103torilor \u015fi lucr\u0103torii afecta\u0163i c\u0103 vor fi implica\u0163i \u00een utilizarea sistemului de IA cu grad ridicat de risc. La cerere, companiile sunt obligate s\u0103 furnizeze persoanei afectate de o decizie luat\u0103 pe baza rezultatelor unui sistem de IA cu grad ridicat de risc explica\u0163ii \u00een leg\u0103tur\u0103 cu rolul sistemului \u00een procedura decizional\u0103, dac\u0103 aceast\u0103 decizie produce efecte juridice sau o afecteaz\u0103 semnificativ de o manier\u0103 pe care o consider\u0103 a avea un impact negativ asupra s\u0103n\u0103t\u0103\u0163ii, siguran\u0163ei sau drepturilor sale fundamentale\u201d, se arat\u0103 \u00een analiza EY.<\/p>\n<p>Regulamentul 2024\/1689 al Parlamentului European \u015fi al Consiliului din 13 iunie 2024, de stabilire a unor norme armonizate privind inteligen\u0163a artificial\u0103 (Regulamentul privind IA) a intrat \u00een vigoare la 1 august 2024 \u015fi este primul act legislativ care urm\u0103re\u015fte instituirea unui cadru uniformizat \u00een aceast\u0103 materie, asigur\u00e2ndu-se c\u0103 dezvoltarea \u015fi implementarea IA nu aduce atingere drepturilor fundamentale \u015fi promoveaz\u0103 \u00eencrederea cet\u0103\u0163enilor \u00een noile tehnologii.<\/p>\n<p>Obliga\u0163iile privind sistemele de IA cu grad ridicat de risc vor intra \u00een vigoare pe data de 2 august 2027. Nerespectarea obliga\u0163iilor privind sistemele de IA cu grad de risc inacceptabil va duce la aplicarea de amenzi de p\u00e2n\u0103 la 35 de milioane de euro sau de p\u00e2n\u0103 la 7% din cifra de afaceri mondial\u0103 total\u0103 anual\u0103 pentru exerci\u0163iul financiar precedent.<\/p>\n<p>\u00cen ceea ce prive\u015fte sistemele de IA cu grad ridicat de risc, amenzile pot ajunge p\u00e2n\u0103 la 15 milioane de euro sau 3% din cifra de afaceri mondial\u0103 total\u0103 anual\u0103 pentru exerci\u0163iul financiar precedent.<\/p>\n<p>Totodat\u0103, angajatorii vor trebui s\u0103 aib\u0103 \u00een vedere amenzile care pot fi aplicate pentru nerespectarea dispozi\u0163iilor \u00een materia protec\u0163iei datelor cu caracter personal. Astfel, acestea pot ajunge, \u00een func\u0163ie de \u00eenc\u0103lcare, p\u00e2n\u0103 la 20 de milioane de euro sau, \u00een cazul unei \u00eentreprinderi, de p\u00e2n\u0103 la 4% din cifra de afaceri mondial\u0103 total\u0103 anual\u0103 corespunz\u0103toare exerci\u0163iului financiar anterior, lu\u00e2ndu-se \u00een calcul cea mai mare valoare.
